By accessing or using the services provided by BriefingSmart (hereinafter referred to as the "Service" or the "App"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use the Service.

 

2. User Registration

All content, features, and functionality available through the App are owned by BriefingSmart INC. and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute any part of the App without express written permission.

6. Subscriptions and Billing

Certain features of the Service may require a paid subscription. Subscription fees, billing periods, and available plans will be presented to you at the time of purchase. We may modify, add, or discontinue subscription plans, pricing, and features from time to time. Subscriptions automatically renew unless canceled before the end of the current billing period. Billing and payment processing are handled through the applicable platform provider, including the Apple App Store and Google Play Store. You may manage or cancel your subscription through your account settings with the applicable platform provider. Except as required by applicable law or the policies of the Apple App Store or Google Play Store, all purchases are final and non-refundable.

 

7. Fair Use Policy

Some subscription plans include features described as "Unlimited," including, but not limited to, unlimited listening and unlimited AI insights. These features are intended for normal personal, non-commercial use and are subject to reasonable fair use limits designed to ensure a reliable experience for all users.

We reserve the right to temporarily or permanently limit, throttle, suspend, or otherwise restrict access to unlimited features if we reasonably determine that usage:

  • Is automated, scripted, or otherwise not consistent with normal individual use;
  • Places excessive or unreasonable demand on our systems or infrastructure;
  • Involves account sharing or unauthorized commercial use;
  • Attempts to circumvent service limitations or security measures; or
  • Otherwise negatively impacts the Service or other users.

Most subscribers using the Service for normal personal use will never encounter these limits. We may modify or update our fair use practices at any time as necessary to maintain the quality, security, and availability of the Service.


8. AI-Generated Content Disclaimer

 

The Service may provide summaries, recommendations, insights, and other content generated or assisted by artificial intelligence technologies. While we strive to provide accurate and useful information, AI-generated content may contain errors, omissions, inaccuracies, or outdated information. The content provided through the Service is for informational purposes only and should not be considered financial, investment, legal, medical, tax, or other professional advice. DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BRIEFINGSMART INC. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT PROVIDED THROUGH THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE.


10. Limitation of Liability
To the fullest extent permitted by law, BriefingSmart INC. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, goodwill, or business opportunities arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages.

 

11. Availability of Service

We reserve the right to modify, suspend, discontinue, or restrict access to any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

 

12. Termination

We may suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App's operations.
